Control of Substances Hazardous to Health (COSHH)

Protect your employees from debilitating diseases such as cancer, asthma and dermatitis. Protect your business from employee lost time, financial penalties and prosecutions by enforcing authorities.

The COSHH Regulations 2002 require all substances used in the workplace that are hazardous to health to be risk assessed and appropriate control measures identified to reduce the harm they may cause your employees or the environment.

This applies to substances that may arise from production processes too!

However it may be that you are currently assessing substances that are have little or no risk associated with their use, and using valuable resources to do so. Legisafe can guide you through the COSHH assessment process and demonstrate using provisions in the COSSH Regulations, that little or no risk substances can be grouped together on one assessment, saving time in both assessing products and communicating the findings to your workforce.

Noise in the workplace

The Control of Noise at Work Regulations 2005

Came into force on the 6th April 2006 and requires employers to assess noise levels in their workplace and protect employee hearing from excessive noise where necessary. If the level of noise employees are exposed to reach 80 decibels then employers are required to assess the risk to their health and provide them with information and training about noise exposure. If the levels of exposure reach 85 decibels average daily weekly exposure employers must provide hearing protection or hearing protection zones. There is also an exposure limit of 87 decibels that must not be exceeded, taking into account any reduction in exposure provided by control measures. Fire Safety

Legisafe can provide fire risk assessments and fire safety advice to ensure that you are compliant with the Regulatory Reform (Fire Safety) Order (RRO) that came into force in October 2006. 

Our experience is that local Fire Service enforcement officers are now getting to grips with The RRO and are beginning to prosecute failings proactively through visits to premises, rather than reactively following an incident or intelligence about an organisation.

A fire risk assessor and a hotelier were both jailed for eight months each recently following visits from their fire safety officers.  Substantial fines were issued to each person too.

Prevention is better than cure!  Contact Legisafe who will conduct a fire safety audit in accordance with BS9999:2008 and provide a fire risk assessment to ensure that you meet the requirements of YOUR responsibilities under the RRO.


Vibration

Similarly to noise causing irreversible damage to ears, vibration can cause irreversible health effects to users of equipment that vibrates. This is a particularly prevalent issue in the construction and maintenance industry with the use of breakers, drills, chain saws, brush cutters and other handheld powered equipment.

Some of the conditions that are known to be caused by vibration are Hand Arm Vibrations Syndrome and Carpel Tunnel Syndrome. Both of these conditions have irreversible effects on the mobility of arms and hands, and the dexterity of fingers.

The Control of Vibration at Work Regulations 2005 requires employers to risk assess tasks that involve the use of equipment that vibrates, and therefore identify control measures to prevent the onset of the conditions mentioned above.

Legisafe consultants can carry out vibration exposure calculations and identify simple methods of controlling that exposure for your organisation.

Whole Body Vibration is also covered in the regulations and affects those who operate machinery such as agricultural equipment, forestry equipment and fork lift trucks. Legisafe can assist with assessing these risks and implementing control measures.


Consultation and Communication

Employers have a duty to consult with their employees directly or through a trade union safety representative or a representative of employee safety (ROES), on matters relating to health and safety.

If you recognise trade unions in your organisation then the Safety Representatives and Safety Committees Regulations 1977 will apply to your organisation.

If you donít recognise unions then the Health and Safety (Consultation with Employees) Regulations 1996 will apply.

Or it may be that your workforce is diverse and has union affiliated and nonunion affiliated employees.

In either case, it is necessary to involve employees in the safety management process, and Legisafe is able to provide guidance on the correct routes to take to achieve compliance with the regulations.


Working at Height

The Working at Height Regulations (WAH) are still often poorly interpreted costing business dearly. The myth that ladders were banned when the regulations were introduced is still heard today. However it is still a sad truth that lack of assessment of working at height, including ladders and stepladders leads to around 85 deaths in the workplace each year. Legisafe consultants can carry out effective working at height risk assessments for your organisation and advise on the control measures you need to ensure your employees are safe when they work at height, including advice on access equipment and fall arrest equipment and ensure that you comply with statutory requirements for inspections of such equipment. Legisafe can also provide training in the safe use and inspection of ladders and stepladders for short duration tasks, access and inspections.


General Construction

There are many hazards associated with work in the construction industry. It is essential that suitable and sufficient risk assessments are carried out for construction work. It is also essential to ensure that control measures identified by the risk assessments are being adhered to.

Construction Design and Management (CDM) Regulations

The Construction Design and Management (CDM) Regulations 2007 place requirements on a number of stakeholders in projects that exceed certain parameters.

Your company may be required to provide a health and safety file to a principal contractor to be able to proceed with work on these work sites.

Legisafe consultants can ensure that your health and safety file will be acceptable to the principal contractor, and that your employees are trained in accordance with the health and safety file.
